USA H-1B Work Visa Applications Period Begins on March 7 2025

The U.S. Citizenship and Immigration Services (USCIS) has officially outlined the eligibility criteria and application timeline for the H-1B visa, a vital immigration pathway for skilled foreign professionals looking to work in the United States.

Purpose of the H-1B Visa

The H-1B visa is specifically intended for professionals engaged in specialized occupations that require advanced knowledge and expertise in fields such as technology, engineering, healthcare, finance, research, and more. This visa allows foreign workers with highly specialized skills to contribute to the U.S. economy. It also extends to distinguished high-fashion models and professionals working on U.S. Department of Defense (DOD) research projects.

Eligibility Criteria for the H-1B Visa (Specialized Occupations)

To qualify for the H-1B visa, both the job role and the applicant must meet specific requirements:

Job Requirements:

  • The position must involve tasks that require the application of specialized knowledge.
  • The job must mandate a bachelor’s degree or higher in a related field, or its foreign equivalent.
  • The job must meet at least one of the following criteria:
    1. A bachelor’s or higher degree (or its foreign equivalent) is a standard requirement for the position.
    2. The job duties are complex and specialized enough to require expertise equivalent to that gained through a U.S. degree in the relevant field.

Applicant Qualifications:

To qualify, applicants must meet at least one of the following conditions:

  1. Hold a bachelor’s or graduate degree from an accredited institution in the field required for the position.
  2. Possess a foreign degree that is equivalent to a U.S. bachelor’s or higher degree.
  3. Have a valid, unrestricted state-issued license, registration, or certification to practice in the field.
  4. Possess progressive work experience or specialized training that is equivalent to the degree required for the position.

Important: Employers must submit a Labor Condition Application (LCA) (Form ETA-9035/9035E) to the Department of Labor before filing Form I-129 for an H-1B petition.

H-1B2 and H-1B3 Visa Categories – Who Qualifies?

The USCIS also administers two additional visa categories under the H-1B classification:

  1. H-1B2: Research & Development for the U.S. Department of Defense (DOD)
    • Requires a bachelor’s degree or higher.
    • The applicant must provide a verification letter from a DOD project manager confirming their involvement in a government research project.
    • An LCA is not required for this category.
  2. H-1B3: Haute Couture & Fashion Models
    • This category is for fashion models working in the high-fashion industry, meeting specific requirements as set by USCIS.
